3. Ley Aplicable y Jurisdicción (Applicable Law and Jurisdiction)
La relación entre el Usuario y el Prestador se regirá por la normativa vigente y de aplicación en el territorio español. De surgir cualquier controversia, las partes podrán someter sus conflictos a arbitraje o acudir a la jurisdicción ordinaria cumpliendo con las normas sobre jurisdicción y competencia al respecto. El Prestador tiene su domicilio en ARONA (Santa Cruz de Tenerife), España.
Para la resolución de conflictos empresariales (B2B), las partes se someten expresamente a los Juzgados y Tribunales de SANTA CRUZ DE TENERIFE, renunciando a cualquier otro fuero que pudiera corresponderles. En caso de que el Usuario tenga la condición de Consumidor (B2C), se aplicará la jurisdicción del domicilio del consumidor.
The relationship between the User and the Provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or resort to the ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard. The Provider has its registered office in ARONA (Santa Cruz de Tenerife), Spain.
For the resolution of business disputes (B2B), the parties expressly submit to the Courts and Tribunals of SANTA CRUZ DE TENERIFE, waiving any other jurisdiction that may correspond to them. In the event that the User ha4s the status of Consumer (B2C), the jurisdiction of the consumer’s domicile shall apply.
4. Exclusión de Garantías y Responsabilidad (Exclusion of Guarantees and Liability)
El Prestador no otorga ninguna garantía ni se hace responsable, en ningún caso, de los daños y perjuicios de cualquier naturaleza que pudieran derivarse del uso del sitio web. A título enunciativo: errores u omisiones en los contenidos, falta de disponibilidad del portal o la transmisión de virus o programas maliciosos o lesivos en los contenidos, a pesar de haber adoptado todas las medidas tecnológicas necesarias para evitarlo.
